Abstract
The article presents an institutional, ideological and comparative perspective regarding Japanese legal reform. It discusses inevitable consequences of legal reform in a democratic country by comparing substantive and procedural justice in the Japanese and American legal systems. It informs that citizen participation in adjudication departs the rule of law ideals of neutrality and objectivity and accepts emotional, social, and political factors for rule of law.
