Abstract
The article focuses on the movements for gay identity and rights in the U.S. It examines the gays' judicial protection in the country in which the Supreme Court extends solitude to five classifications including race, national origin, and alienage. It explores the Footnote 4 of the United States v. Carolene Products Co. case in 1938. It discusses the essay of Bruce Ackerman regarding the case in which he contends on the court's description of a minority formulation as insular.
