Abstract
The essay explores how patent law in the U.S. can be structured to support Internet innovation. The theories of the Internet, as put forth by the books "The Future of the Internet--And How to Stop It," by Jonathan Zittrain, and "In Search of Jefferson's Moose: Notes on the State of Cyberspace," by David Post, are discussed. The importance of patents for startup Internet software companies, which prevents larger firms from copying their software, is noted.
