Abstract
The article attempts to analyze the role of choice of law in selecting a forum to hear a class action and the effect of choice of law on interstate forum shopping in nationwide class litigation. It accounts how courts tended to deal with choice of law issues in class actions prior to Class Action Fairness Act of 2005 (CAFA). It addresses whether aggregate litigation justifies a choice of law rule, and whether CAFA calls for a departure from Klaxon.
